@snathan oh no he never got me any interviews , he was basking away in the sun with his wife on the hammock with him, these were all my efforts of trying to find a job somewhere by posting on job sites, calling up companies, using my friend's reference, but i realize that even doing that companies here follow a longer process or some no process to actually keep the candiate informed about the status. This was way different in my home country.
anyways yeah i know atleast 5 guys who have all been thru this company who have all flown in on their own and who did not blow the whistle.

I am in same boat as you.
2 i-140's approved with same company, both are EB2, one is RIR one is PERM.
PERM one had Jan 2006 PD where my RIR had Nov 2004.
I-485 was applied using Nov 2004. USCIS may be looking at other one and thinking PD is not current. What a mess.

Below is the text for Waivers.. My understanding is that if end Client gives a letter to DOL stating that they don't layoffs due to this H1B and it is a temp. labor requirement etc.. It is still harsh considering anti-immigration climate.. What is feared asked in a Visa interview will be asked by DOL for extensions. So, H1B can't be on an auto-pilot mode..
``(I) the employer with whom the H-1B nonimmigrant would be placed has not displaced, and does not intend to displace, a United States worker employed by the employer within the period beginning 180 days before and ending 180 days after the date of the placement of the nonimmigrant with the employer;
``(II) the H-1B nonimmigrant will not be controlled and supervised principally by the employer with whom the H-1B nonimmigrant would be placed; and
``(III) the placement of the H-1B nonimmigrant is not essentially an arrangement to provide labor for hire for the employer with whom the H-1B nonimmigrant will be placed.
the big consulting companies (IBM/Deloitte/Accenture et al) will try to get a waiver by showing the 3 conditions above - however, they need to do so every time a current assignment for their H1B employer ends and they need to place them on a new assignment / client. At that time they need to go through the waiver again, to determine whether the end client has had any layoffs in the last 180 days.
In short this bill is a disaster for ALL CONSULTING companies that have a large H1B population.

we have created these strategies based on advice and feedback from the offices of friendly lawmakers, advice from professinal lobbyists and our own experience so far. the "assistants" you speak too keep running tallies of phone calls on a given issue and these are communicated regularly to legislative directors and lawmakers. digital signatures and even digital petitions are given less weight- handwritten snail mailed letters on the other hand are treated with great importance.
you may wish to google the nyt articles on how numbers usa operates to derail bills- they call! if our members would show the same enthusiasm and every single person would call when requested, we could have the same impact.

You are right to be cynical and without the vb helping us in a perverse way maybe the fundraising wouldve been doa. still, it just doesn't feel right - Im too tired to backit up in a convincing way now, maybe tomorrow- but as i said earliuer its just a gut feeling.

We all had a good time so far in US compared to the freshers .
It seems like any change in the immigration system is only going to land us in a worst position than we are in....
And looking at what is happening, I think it is naive to think we can influence the system to make it better for us.
Any noise we make seems to be making our opponents solidify and press us even harder.
I know this is not an upbeat comment that every IV member seem to expect, but this has been a depressing week, in an already depressing decade. :(

borgho - Your first point about big companies not cooperating in this is a very true and important point.
Yes, only some progressive companies with progressive thoughts will actually do something. As such, only progressive politicians will do something about.
Rest, they don't care. If they get someone (Citizen, H1b, L1, b1) anything they will get their work done. In big companies the issue is with heirarchy. You superior would love to do something for you because you work hard and get him good name but then managements are not like that. They are selfish. They would like to cut costs and if possible they would love to see your job going overseas ASAP after keeping you as contractor tillwork gets done. These companies will never change. Never rely on such companies.
Mid sized companies with energetic entreprenuers who have progressive ideas and thoughts would actualy fit our cause. They see you as an integral part of the organization and would like to help.
About DL: it is crazy. I made 5 visits to DMV CT to get my out of State DL renewed.

FRAGOMEN and the American Council on International Personnel (ACIP) will continue to work with the government at all levels for some kind of relief, but again the form of any potential relief is uncertain."
Why is the above important? Because it's a window into their mindset. Like any responsible corporate firm they wanted to sound a little empathetic but didn't want to give false hopes by saying a reversal was possible though they probably knew the outrage among potential filers who had been dealt a nasty blow below their belt. But VB disaster was one issue where there was not even the slightest doubt that what had happened was horribly wrong and cruel that even some cold-hearted anti-immigrants were confused for a day or two and didn't know what to say because they didn't want to pile on our heartache. The way CIS works had, like any bureacracy over time become a cold and heartless beast but since they deal mostly with non-citizens who have little rights and feel so unsecure and unwelcome in the first place to ever speak out, they were never going to know how their actions are wreaking havoc on their customers lives. So unless affected people come together and act they are never going to know how bad it sucks to be on this end of the divide. And ofcourse it's not all CIS - they are just an arm of the government carrying out the law. it's going to be next to impossible to do anything without congress stepping in. And while Fragomen is definitely not lying when they say they will work for some relief and probably are given that their partners often show up on congressional hearings, they won't lose sleep over it nor will their passion levels be anywhere near that of those who are directly at the receiving end of this current ugly messi.e iv and it's browsers. For all well qualified EB-3 folks it is a good and legal way of getting out of this EB-3 India mess.
Many in IV will know that I have never opposed legal porting. However, I disagree that this is a way to get out of the mess. There is a fixed total number of Visa available. Per current rule this first comes to EB2 and is consumed completely leaving nothing for EB 3. If all (or majority) EB 3 moves to EB 2, the chocking will be in EB2 . So the "mess" just shifts its position.
The true way is -- 1) Recapture, 2) Exclude dependents from Visa Number
