    We are planning to get our passort stamped (H1B/H4) at Mumbai consulate. Does anyone know how many pay-stubs I will need from my current employer? Can anyone please share their experience?

    I am in H1B and more than five years. My employer is a mid size
    private Indian company. They start bringing more and more L1B
    people and post them in client location. Their LCA is for 55K and they
    are paid only 30K even though the billing is in three digit. All the
    accomodation, per diem are paid by the client. We are into one of
    the XXX product and there is no custom product from our company.

    Whats the best way to deal with this guys. Whom should send I the
    complaint about this. What they are doing is a complete violation
    of law.

    So please guide and share you experience.

    P.S. If you dont have any information, please stay away. Do not
    start the H1 vs L1, Anti-immis troll alert. Thanks for your
    understanding. This has nothing to do with the L1 employees.

    Just curious..if you can answer the below questions, I'll google my fingers off to get you information you need.

    Why not disclose your employers name?
    Does your company just pay low wages to others and pay you very well?
    If your company is violating US laws, why are you with them?

    I had the same situation for my daughter who turned 14.They requested for biometric fee $80.00.It should be simple and OK.just pay the the amount and you should be fine.After that you may get a FP notice.

    Once we sent the bimetric fee,proceesing resumed and everything was fine.

    Same here. My daughter turned 15 and got 2nd FP notice but NO fees as you mentioned but her was transferred to another center few months ago.

    I really don't understand the logic of fees. PLease correct me if I am wrong here -I thought there is a 'lock-in-date' which is at the elegibility data at the time of filing. This saves all concerns of aging out and issues regarding fees. They can't keep asking for enhanced fees for already filed cases.

    I received an invitation letter from Congressman Marty Meehan to attend the town meeting at 10am 12/16 at UMass Lowell.

    Although the topic of the meeting is "Climate Change: Local Solutions to a Global Crisis". But it will be a good chance for us to meet congressman.

    Congressman Marty Meehan is Fifth Congressional District of Massachusetts He does not support the CIR but he do support the elimination of backlog of GC. He is a member of both the House Armed Services and Judiciary Committees.

    Even though we have a very honest agenda at heart which at its very core aims to help America be more competitive in the global scene, apparently, we need to have the financial clout to be able to turn heads and thus have our voices heard.

    Here is an idea: say we have roughly 500 members out of this vast array of 35000+ members who have the heart and the will to contribute. we get $2000 from each and place it in an escrow trust account that does not release money for expenditure unless we reach $1 mln

    why? because the first 10 or 50 contributers are the most elemental in getting such a campaign off the ground and we need to give them a guarantee that its an ALL or NOTHING DEAL. If for some reason we stop at $10k because only 5 members contributed and no more are ready to contribute (unlikely), those 5 members can get their money back.

    now is $2000 a huge amount?.. absolutely... but maybe we could tweak this amount or do some payback if we have more people stepping forward in excess of 500. and the amount of payback depends on how early your contributed to the campaign. The first 50 guys could even get a substantial part of their contribution back.


    People, we gotta swing for the fences, the next time we go to play.
    It has taken us some time to understand how the lobbying game is played.. but this time "Lets play to win"
    As evident from current campaigns (http://immigrationvoice.org/forum/showthread.php?p=210276#post210276), we need to be a big fish.. a million $+ whale to be taken seriously.

    Lastly, i'm just presenting an idea .. its not endorsed by IV core.. and I maybe overlooking some finer points of non-profit corporate taxation and finance.

    dude I am in a similar position.....got laid off on march 27th.....got my 2yr EAD on Apr 1 and now a soft LUD on my 485 on 4/10.........and my date is nowhere close.....its feb 07....not sure whts going on.....I discussed it with an attorney in worse cum worse case I will be exploring the self employment clause onyou EAD......

    Anyways if they issue an RFE isn't it generally mentioned there....in my case its not stating any status change........just a soft LUD

    Is your case in TSC?
    Are you US educated?
    Did you file G28 recently?

    Just trying to find a pattern here.........

    i am going to do almost exactly what you are thinking in a matter of few days. i spoke to two lawyers. essentially, ac21 allows this and there is nothing that you have to really do. Of course, i am assuming that you are moving into a job that has the similar job duties as specified in your labor application. what you need to do is make 100% sure that you have documentation to prove this job duties similarity. if you are going to get an SOW from your client, make sure that the SOW is similar to your labor. if you can, do get a letter from your client (where you will do your actual work) stating your job responsibilities, work content etc. you will also need to document/prove actual existence of your business by showing your tax transactions, invoices/receipts etc. also, make sure that you are spending 40 hours (or whatever is the equivalent of a full time job) doing your labor certified job... all this will be required only if USCIS sends you an RFE or calls you for an interview.

    Don't you think if you're changing jobs and new job has to be fulltime with new employer? not contract?

    Can we invoke AC21 on temp contracting job?

    As you said if you go with contracing job where you will be running your payroll? Is it on your new owned company on your name? Or it has to be someone else name like spouse or friend?

    Frist's enforcement only bill will be very popular in the house, but is unlikely to pass the senate. There seems to be quite a few republican senators (Specter, Mccain, Graham, Brownback to name a few) who might vote against any bill which is not "comprehensive". They along with the dems easily have more than 50 votes to block. Now, even if Frist's passes senate, it has to be reconciled with the house version - there are plenty of vocal anti EB folks there and hardly anyone pro. So if push comes to shove, Frist would probably agree to drop the EB provisions and pass rest of the bill , so that he can take credit and hit the '08 presidential campaign trail.

    Specter's will easily pass the senate, will be a miracle if it passes the house - senate conference commitee in its present form. The only hope is all the attention will be on the amnesty provisions and negotiations surrounding that, and the EB part of it will fly under the radar.

    I am very keen to try and get a state chapter from Indiana. There have to be at least half a dozen of us.

    There are millions of Starbucks in the area, maybe we can monopolize a corner in one of them some time.

    From what I have read here then most of the replies are in the Indianapolis and northern suburbs, so I am proposing that we meet this Saturday at the Starbucks in Westfield!

    By this location I mean where Ashleys furniture is on US 31 and 146th Street.

    I can make it any time on Saturday but we have to set on a time, I am suggesting 11am.

    Does this mean I can port the PD even if I moving from a technical position to a managerial position in a different company. of course I know one has to file a new perm and I140 with the new company.

    I think you can - however, please get some legal consultation for that from a good lawyer.

    I think it might be CT issue. There is an ongoing immigration fraud investigation against state employees so now they are over doing enforcement.

    So am I correct to assume that there is no need to renew the I-94 if one enters using the AP.. I am myself also planning to use my AP for re-entry later this year, but have the H1-B approval valid till 2011, so was a little confused as to if I would be needed to renew my new I-94 if it is issued for 1 year based on AP..
