    How does insulting your own culture help us here ? "Crab mentality" as it is popularly known, exists in numerous cultures across the world. Go google for the term and you will know.

    It reminds me this story every time I visit IV.

    Workers working with an export company which use to ship chickens from all over the world to US/Europe, were packing chickens from some Indian port. Each box was having some 50-70 chickens in it .

    After loading them in, they were about to cover these boxes with the tops. The leader shouts to workers: " No need to put the tops. They wouldn't go any where "

    Surprised with this order, one worker asks the leader 'Why'. The leader says : " These are Indian chickens. IF one tries to escape, other will pull its leg."

    I'm sure people here dont have that agility and adaptability to adjust in India and China. Though I heard lots of gora are in Hyderabad and other cities that wont be for long term. And without people from India/China IT can't survive here. Much bigger market (than Internet) will be fighting global warming. These guys won't screw their future by doing all these nonsense laws.     On Aug 11, 2007 - I 140 Denied Due to Ability To Pay issues

    Description for denial ( I have also attached the denial notice)->

    They looked at years 2003 to 2006 history for I140 since PD is JAN 03.

    * Reason 1 - Lower salary than specified in labor
    Preferred Wage in labor - 78,750
    W2(2003) - $76,850; W2(2004) - $75,638; W2(2005) - $31,652;
    W2 for 2005 is less due to company merger. I have another W2 from new company for 2005. I moved to another company due to merger but lawyer continued GC throgh old employer since the both companies exists after the merger.

    * Reason 2 - negative net income of the petitioner
    2003 (-$537,841); 2004(-$445,493); 2005(-$527,298); 2006(Not Submitted);

    * Reason 3 - 2003 and 2004 OK but net current assets are -ve in 2005
    and my lawyer did not provide 2006 information

    oh and yes, it is easy to file a claim with DOL on your employer - since YOU paid the fees employers has already did bad.

    Not being judgmental at all. This is a question that has to be posed to the HR department in the company and not to 'peers' on a forum. The profile says he/she is on EB2 and then he/she goes on to ask this

    "let me know if they have done EB2 with this scenario." WTF! :D While I'm not against getting your degree online or IGNOU but you need to at least have the acumen to geo-locate yourself it nothing else :D Other skills are far superlative and come much later :D

    guys - i want to start a new forum on 401K ..

    want to discuss what happens to people who have 401k contribution and want to go back to india

    do we have to withdraw the 401K when we leave or can we withdraw it at a later date..

    can some one start a new thread since i cannot figure out how.. thank you
    401k is YOUR money (all that is vested). You can withdraw it whenever you want. Its not like SS benefits. Having said that, you dont have to withdraw it if you dont have the immediate need. Even if you go back, just let it be there, it will be kept invested, and will hopefully continue to grow.

    And when you feel the need, just withdraw all/part of it. You will have to pay the taxes that were deferred, plus a penalty of 10%. But, with the company matching and the investment growth, in all probablity, even with the penalty+taxes, you will withdraw more than you have invested. So, dont worry about 401k.

    Just a note( i am not trying to deter anybody or argue against your compilation) that by law all foreigners are required to carry their passport, how many of us follow that, on that note, I will not carry original with me at all. just my 0.02 cents.

    True, we do not carry passports every time we step out of our house (for example, when going to pick up Bud Lite from my neighboring grocery store). But I would think that passports, unlike the PR card, are not designed to be tucked into your wallet for carrying around.     The Gandhi Protests
    Denied the permanent U.S. residency they'd been promised, high-skilled workers are taking to the streets in nonviolent protest



    Engineers, computer programmers, and tech workers aren't known for outspoken collective action and political protest. But on July 14, up to 1,000 high-skilled, legal immigrants will gather in San Jose, Calif., to express their outrage at the U.S. government's failure to deliver on a promise to hasten the processing of their green-card applications. Many of these immigrants came to the U.S. from India on visas and have been stuck in what they say is an interminable wait for permanent residency and the freedoms it brings.

    "We're stepping out to bring this issue to the attention of lawmakers and the public," says Ashish Sharma, 37, who has worked as a manager at a tech firm in Los Angeles for seven years, awaiting his green card. "The debate has been dominated by illegal immigration, but we want to put a spotlight on the hurdles we're facing as a hard-working and law-abiding group. It's time for corrective action."

    Sharma says he spent $5,000 flying his wife and children to the U.S. from India to prepare green-card documents that the government originally said it would accept and then later decided not to accept. Tomorrow, he will drive more than five hours to San Jose to meet hundreds of others stuck in the green-card backlog who want to make a public statement about their frustrations.
    Long Delays Spur Protests

    The rally follows a symbolic action on July 10 in which hundreds of green-card applicants sent flowers to the director of U.S. Citizenship & Immigration Services in a show of peaceful protest reminiscent of Mohandas Gandhi's nonviolent campaign against British rule before India gained independence in 1947. The idea for both the flower sending and the rally emerged from Immigration Voice, a group that advocates for high-tech immigrants in the U.S. on visas.

    The Gandhi protests, though grounded in years of frustration and anger, were sparked by recent events. On June 12, the U.S. State Dept. issued a bulletin promising it was ready to move hundreds of thousands of green-card applicants into the final phase of processing, known as the Adjustment of Status. Visa workers rushed to complete their Adjustment of Status applications for July 2, the first day they could be submitted. Applicants scrambled to gather signatures, birth certificates, and immunization records, many taking off work and rearranging travel plans. But at the beginning of July, the State Dept. retracted the bulletin, explaining the U.S. Citizenship & Immigration Services had already fulfilled its quota and would not accept further applications. The immigrant community exploded, with critics saying they are the victims of bureaucratic incompetence and a broken immigration policy.

    The green-card backlog has emerged because of a mismatch between the number of visa holders and the number of green cards available to them each year. Tens of thousands of foreign workers enter the U.S. on work visas each year, and many apply for green cards. But current government rules limit the number of people who can be admitted to the U.S. from any particular country to 9,800. The result is that for larger countries, including India and China, the wait for permanent U.S. residency now stretches for years. As they wait, visa workers are required to maintain the same job and salary, or they are bumped back to the long queue. That leaves many of the most educated and talented immigrants feeling stuck, sometimes to the point of hopelessness (see BusinessWeek.com, 6/21/07, "One Easy Fix for Immigration").
    Joining the Chorus

    Many American companies are concerned about the government's immigration policies. Tech companies, including IBM (IBM), Motorola (MOT), Oracle (ORCL), eBay (EBAY), and Intel (INTC), have pressured Congress to allow in more skilled workers on temporary and permanent visas. Google (GOOG), with many immigrants at the company including one of the founders, sent one of its top executives to make the case in Washington (see BusinessWeek.com, 6/7/07, "Immigration: Google Makes Its Case"). Bill Gates, Microsoft's (MSFT) co-founder, also made the trip to Congress to argue for a change in policy (see BusinessWeek.com, 3/8/07, "Gates to Senate: More Visas").

    Immigration Voice has for several years been a forum for visa workers awaiting green cards, but it is now becoming a critical organizing tool through its Web site, volunteer leadership, and increased lobbying efforts. Immigration Voice President Aman Kapoor says green-card applicants are busy organizing a series of rallies to take place across the country on one day next month.

    "This is not the usual population to go into the streets and protest; it's a group that has remained quiet and follows the rules," says Kapoor. "But people have lost faith in the system, and we have reached a tipping point in terms of frustration. There's an understanding that more dramatic action is needed."

    I have come across at least one-colleague in every client place who left U.S.A - after being here for more than 7 years. And they do have children, houses and handsome salaries. And I know of number of people who have plans to eventually go back. But it's just matter of time and money. If property prices were not crazy in India, I am sure more people would have left by now.

    I saw some postings saying that USCIS can assume the name check is done and is OK if FBI does not get back in 6 months and thats how they managed to approve all those cases in June, is this correct?

    I believe the guy or girl who made comment on Immigration website has more like a grudge and might be carrying some old IV mistakes like lack of transparency we had in past etc. But gotta understand, everyone makes mistakes and improve.

    More, I don't understand that if that guy doesn't want to contribute coz he or she is poor - thats fine. He will still get benifits from IV efforts.

    I was seeing lot of posts in this forum about reverse brain drain, so I wanted to comeup with a question which would answer my question without doubt.
    I wanted to see if all those who are in the GC queue and think that they are a very important for America and insist on that in their signature by saying "Help us stop reverse brain drain" are really meaning what they say.

    I beleive if we are so much in demand we can get a job in another country and have similar quality of life or better. So only poeple who are confident of the reverse brain drain and America should stop it will not hesitate to vote "Yes" if they are so frustated with the GC wait times.

    Once again thanks to everyone who so far particiapted in this poll and posted comments.

    Some people have given me negative reps for this poll saying it is useless but never say why "they" think it is useless. I would appreciate if you can post your opinion with those negative reps. Offcourse postive reps can be without opinon :D
